Not only was I NOT READ MY RIGHTS after arrest, but wasnt given a copy of the warrant re:charges OR complaint?
I’m a 60yr old female from Tennessee. I bought a set of Meadowcraft furniture from a fly-by-night and yesterday was arrested for possession of stolen property. The officer told me to go with him and took me to meadowcraft georgetown collection jail where I was booked. The Deputy said I was NOT UNDER ARREST but only under investigation. Also said the Criminal INVESTIGATOR was coming to talk to me and that I COULD be released. After 4-5 hrs in the cell, the Investigator never came. Suddenly, the jailer unlocked the cell door and said a warrant for arrest had been issued for theft of property over $1,000 (a Class E felony)I was not read my rights or given a copy of the warrant OR the complaint against me, only told that bail would be $500. Is there ANYTHING illegal about any of this? I have no criminal record. I would be grateful for ANY advice. Thank you so very much!

They don’t have to read you your rights if they aren’t going to question you. Since they didn’t question you, no rights required. If you bailed out for $500, they must have given you a court date for arraignment. That is the day that they will formally read the charges to you, you can enter a plea (if you had an opportunity to consult with a lawyer), or you can ask for a court appointed lawyer if you cannot afford one. What you need right now is the advice of a criminal defense lawyer. If you can afford one, call one today.
